1. Introduction

These Terms and Conditions ("Terms") govern your use of the Sound Nutrition mobile application ("the App"), provided to help you make smarter, healthier eating choices through nutritional calculations and information. By downloading or using the App, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please do not use the App.

Sound Nutrition is intended for use by the general public and is currently offered free of charge.

2. User Responsibilities and Acceptable Use

By using Sound Nutrition, you agree to do so responsibly and in accordance with these Terms and all applicable laws and regulations.

Important Health Disclaimer

Sound Nutrition is based on official guidance from the United States Dietary Guidelines for Americans. These guidelines aim to promote health and prevent disease but are not intended to serve as clinical advice for the treatment of chronic illnesses.

According to the Dietary Guidelines:
"The aim of the Dietary Guidelines is to promote health and prevent disease. Because of this public health orientation, the Dietary Guidelines is not intended to contain clinical guidelines for treating chronic diseases. Chronic diseases result from a complex mix of genetic, biological, behavioral, socioeconomic, and environmental factors, and people with these conditions have unique health care requirements that require careful oversight by a health professional."

Accordingly, you should not use Sound Nutrition as a substitute for professional medical advice, diagnosis, or treatment. Always seek the guidance of a qualified healthcare provider for any medical condition.

Prohibited Activities

• Rely on the app in place of professional medical or nutritional advice where applicable.
• Attempt to copy, reverse engineer, decompile, or otherwise tamper with the app or its underlying technology. Patent pending.
• Use the app in any unlawful or harmful way.

User Data

Users may input and store personal or health-related information within the app. This data is stored locally on your device. A history of user-logged nutritional and health data may be backed up to your iCloud account if enabled. Sound Nutrition, LLC does not collect, transmit, or access any user-entered data.
Sound Nutrition is available for users of all ages; however, children under age 13 should use the app with adult supervision.

3. Intellectual Property

The Sound Nutrition app, including its design, layout, structure, functionality, features, and calculation methods, is the exclusive property of Sound Nutrition, LLC and is protected by intellectual property laws. All rights not expressly granted are reserved.

While the majority of nutritional content and guidance presented in the app is based on official public health information sourced from MyPlate.gov, all original elements of the app — including proprietary calculations, user interface design, data organization, and app implementation — are the intellectual property of Sound Nutrition, LLC.

Any attempt to copy, reproduce, reverse engineer, or repurpose the app or any part of it is strictly prohibited.

User-Generated Data

Users may input personal nutritional intake and health information into the app. This data is created and owned by the user and stored only on the user’s device and iCloud (if enabled). Sound Nutrition, LLC does not access or store any user data.

Some original content, such as some guidance in the Information Section of the Summary tab, is provided by Sound Nutrition, LLC and remains the company’s property.

4. Privacy and Data

Sound Nutrition respects your privacy. The app is designed to operate primarily on your device. However, certain user-generated data may be backed up to your personal Apple iCloud account, depending on your iOS settings.

• All personal and health-related information entered by the user is stored locally on the device.
• A history of user-logged nutritional and health data is backed up to your private iCloud storage if iCloud backup is enabled on your device.
• Sound Nutrition, LLC does not collect, access, or transmit your personal data to any external servers or third parties.

Sound Nutrition does not use third-party analytics, advertising networks, or cloud-based services operated by the company. You retain full control over your data through your device and iCloud settings.

5. Disclaimer and Limitation of Liability

Sound Nutrition is provided “as is” and without any warranties, express or implied. While the app is designed to offer helpful nutritional guidance based on authoritative sources, Sound Nutrition, LLC makes no guarantees regarding the accuracy, completeness, or reliability of the information provided.
To the fullest extent permitted by law, Sound Nutrition, LLC disclaims all liability for any harm, loss, or damage — including but not limited to health issues — arising from the use or misuse of this app. Users assume full responsibility for any decisions or actions taken based on information provided by the app.
Sound Nutrition does not provide medical advice, and the content within the app should not be used as a substitute for professional medical consultation, diagnosis, or treatment.

6. Modifications and Governing Law

Modifications to Terms

Sound Nutrition, LLC reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective upon posting the updated Terms within the app or on the company’s website. Your continued use of the app following such updates constitutes your acceptance of the revised Terms.

Governing Law

These Terms and any dispute arising out of or in connection with your use of the app shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
